Privacy Policy

Our commitment to your privacy:
Welcome to Brainbiochem.com, a registered research facility that develops pathology supported life-style intervention programs in collaboration with scientists, dieticians and clinicians. Our educational and genetic counselling services support these testing services offered in association with diagnostic laboratories that abide by our privacy policy.

How we use your information for service delivery:
Brainbiochem handles your information in a highly confidential manner according to the consent you are requested to provide for requested tests or other services. When educational services, genetic counselling and/or analysis of genetic or other materials are requested from Brainbiochem, or any of our partner companies, relevant personal, medical, clinical and/or lifestyle-related information are entered into our client database. At request of a test, the client needs to provide the name and contact details of his/her healthcare practitioner, who would then also have access to the information entered. In the event that the client does not have a referring doctor, pre-test genetic or other counselling is required and relevant client information forwarded to one of our registered genetic counsellors to further manage the process of genetic testing service delivery. A participating laboratory in closest proximity, or best equipped to perform the test requested, will receive all relevant information together with the specimen for genetic or other testing. Brainbiochem combines the test results produced in the laboratory with the clinical and/or lifestyle information (provided at referral by the client and his/her consulting healthcare professional) to generate an informative test report. The test report may include health guidelines/recommendations in addition to the diagnostic and predictive information provided in genetic test reports; therefore, preparation of the reports usually involves the input of professionals from different health disciplines.

Use of your information for market education:
Brainbiochem may use your information to present statistics on the users of the website relating to personal information such as age and gender and the frequencies of specific genetic (or other) variations in different population and patient groups. In the process of presenting such statistical data, Brainbiochem will ensure that users identities are not disclosed. We may furthermore use your contact information to inform you of new products and services. We may also request your feedback on your experience of using the Brainbiochem service in order for us to improve the service provided. In the instance that Brainbiochem hires another company to perform certain business-related functions we seek to provide them only with information relevant to the service required. Brainbiochem cannot be held responsible for use of information by other companies; therefore strict confidentiality is required from all associates and consultants as stipulated in our service contracts.

Keeping your information:
Unless otherwise specified, Brainbiochem will keep your information for as long as necessary to allow data mining over time as part of our commitment to research. You are provided the opportunity to decline use of your information and genetic (or other) materials for research purposes relating to the service requested. Genetic (or other) material will be stored at the reference laboratory indicated on the test reports for as long as the law requires or that is reasonable under the circumstances. Genetic (or other) material may be collected from participating laboratories for storage at the Pathology Research Facility, University of Stellenbosch, South Africa, for inclusion in long-term research projects with ethical clearance, or for quality control purposes involving exchange of samples between different laboratories performing the same service. Exchange of samples between laboratories is necessary to ensure that all produce the same results, thereby minimising the possibility of inaccurate results provided by any of our participating diagnostic laboratories.

Access to personal data:
Brainbiochem uses a secure network accessible only by a limited number of password-authorised personnel. The information you provided and generated by the service provided to you will not be provided to any third parties without your permission. The only exception is if this is required by law and insofar such data forms part of your test report, which will be circulated to the consulting healthcare practitioner(s), co-writers of the report and the participating laboratory. Only the employees and sub-contractors of relevant companies have access to your data to the extent of their role in the genetic testing service delivery process. If, in future, our business merges with another company or is sold to another business entity your data may be disclosed to the new owners or business partners. Your DNA or other information will not be sold to other companies in other events.

Legal requirements and business transfers:
Brainbiochem may disclose your information if required by law or to comply with a legal obligation, to protect the rights of Brainbiochem or its affiliates, to protect the personal safety of clients and against legal liability. In the event that our business is sold, restructured, reorganised or the assets affected in any way, the information included in our genetic database may form part of the process or transferred assets.

User submissions:
No internet transmission is ever 100% error-free or safe. Therefore it is important to take special care in deciding what information is sent to Brainbiochem.com or entered online. Furthermore, when passwords or other special access features are used on this website, it is your responsibility to safeguard them. You are prohibited from posting or transmitting to or from this website any obscene, unlawful, pornographic or other information that may expose Brainbiochem to liability or would violate the law. You agree to indemnify Brainbiochem for any claims, damages, losses or actions arising out of your use or transmittal of information relating to this website. Any action arising in connection with your use of this website or the services offered must be brought to our attention within one (1) year of the date of occurrence of the event that led to such action.
